Cannabis, cannabis resin, cannabis and its derivatives are listed as Schedule 1 drugs under the Misuse of Drugs Acts of 1977 and 1984 of the country. Except under license from the Minister for Health, the manufacture, production, preparation, sale, supply, distribution, and possession of cannabis is unlawful for any purpose. The Irish Police (gardaí) cannot arrest for simple possession if it is satisfied with the name and address of the offender. However, possession of cannabis is an arrestable offence. The first offence is punishable to a fine not exceeding €381 on summary conviction, or on conviction on indictment, to a fine not exceeding €635. A fine not exceeding €508 is imposed on summary conviction for the second offence; a fine not exceeding €1,269 can be imposed on conviction on indictment. A fine not exceeding €1,269 or, at the discretion of the court, and/or imprisonment for a term not exceeding twelve months may be imposed on summary conviction. A fine of such amount as the court considers appropriate and/or imprisonment for a term not exceeding three years on conviction or indictment.
